Minutes of Ordinary Meeting of the Newtown Municipal Council at the Town Hall on the above date at 7.30pm.
The Mayor (Alderman Morgan) and Aldermen King, Turtle, Cox, Elstub, Smith, Edwards, Salmon and Lewis also Hitchcock.The Mayor apologised for the absence of Alderman Rigg owing to indisposition.
The Minutes of the previous meeting were read confirmed and signed.
From the Department of Public Health forwarding report by the Government Analyst on 16 samples of milk submitted by this Authority on the 25th of November for examination advising that the chemical evidence of numbers 364 and 366 is such as would support a prosecution if undertaken.Received and the Mayor authorised to take the necessary steps to prosecute.
From the Department of Public Works submitting revised Ordinances for the Solicitation or Collection of Money in Public places the Proclamation of which will be held over and included in the consolidated set of Ordinances now being prepared. Received.
From the same (Circular number 134) forwarding copy of a Proclamation published in Gazette 20th November determining the number of Aldermen for each of the Municipalities named and the number of Aldermen for each Ward. Received.
From the same (Circular number 131) forwarding copies of the system of Municipal Accounts which it is proposed to bring into operation on the 5th of February next together with copy of the report of the Committee on Municipal Accounts.
From the Department of Public Works (Circular number 137) directing attention to proclamation published in the Government Gazette of 20th of November that the General Fund of the Municipality may be applied in repayment of the monies temporarily borrowed under Section 176 of the Local Government Act 1906 for the purpose of carrying out the works or services to the carrying out or performance of which the General Fund may be applied. Received.From the same (Circular number 139) re-Appeals against Valuation 1908 pointing out that Section 139 of the Local Government Act provides that where Courts of Petty Sessions are Appealed Courts under the said Act Appeals against valuations shall be heard at such places as the Governor may proclaim and asking this Council to intimate to the Department as early as possible the names of places where they desire the Petty Sessions Appeal Courts to sit next year.Received and the Police Court Newtown appointed the place for hearing and determining appeals against valuations.
From the Under Secretary Department of Lands inviting attention to a notice in the Government Gazette of the 4th December relating to the remarking of alignment of Enmore Road Municipality of Newtown under the Public Roads Act 1902.
From W. Leary and Son notifying their intention to erect cottages in Federation Road and submitting plans and specifications for approval. Received and referred to the Works Committee.
From John Dickson asking permission to erect four cottages in Pearl Street according to plan and Specification submitted for approval.Received and referred to the Works Committee.
From F. W. Turner James Stevenson Alfred Poole and Joseph Howarth Scavenging Contractors asking the Councils consideration of their appeal for an increase of the contract price in view of the increased cost of fodder.Received and referred to the Finance Committee. Darley Street
From John Archibald and J. Palazzi covering requisition from the Ratepayers and residents of Maria Street asking that the name of the street be altered and suggesting that it be renamed Darley Street.Received and request complied with.
The Finance Committeereported having paid accounts under votes of appropriation since 12th November 1907 amounting to £747.10.0 and recommending accounts for payment amounting to £770.The Mayor moved that the Finance Committees report as now read be and the same is hereby adopted.”Seconded by Alderman Salmon and carried.
The By laws Committee
submitted their report dated 10th December 1907 relating to the draft Ordinances prepared by the Department of Public works with their amendments suggestions and recommendations.
The Mayor moved: That the By laws Committees report as now read be and the same is hereby adopted. Seconded by Alderman Salmon and carried.
The Overseer of Works
reported a number of works carried out under his supervision during the past fortnight and works in progress. Received.
The Inspector of Nuisances
amongst other matters reporting having purchased eight samples of spirits from different Hotel keeper’s and submit them to the Government Analyst for examination. Received.
Motions Pursuant to Notice
The Mayor moved:1 “That in accordance with the provisions of the 103rd Section of the Local Government Act 1906 and subject to the approval of the Governor this Council fixes the fees for renewing and issuing new licenses for the registration of Milk Vendors trading within the Municipality for the year commencing 1st January 1908 and ending 31st December 1908 as follows:Cart Vendors 5/- Shop Vendors 2/6.”Seconded by Alderman Edwards and carried. 2 “That any person requiring a copy of the following forms or lists be charged the sum set against each.”(a) Form of claim to be inserted in Lists of Electors and declaration form. Ordinance 10 (4) 6 pence.(b) Form of objection to names already on Lists and declaration form. Ordinance 10 (4) 6 pence.(c) Lists of persons claiming to be entered on the List of Electors. Ordinance 10 (5) 1/-(d) Lists of persons objected to. Ordinance 10 (5) 1/-(e) Role of Electors. Ordinance 17 2/-” The mover consented to the amendment of item (a ) by omitting the word “form” and substituting therefor the word “copy” in the first line. Alderman Edwards seconded the motion as amended and it was declared carried.3 “That the sum of £500 on deposit with the Government Savings Bank of New South Wales be withdrawn and together with accrued interest paid into the General Account with the Bank of Australasia Newtown.”The mover with the concurrence of the Council amended the motion by omitting the words “together with accrued interest”.The motion as amended was seconded by Alderman Edwards and carried. Alderman Turtle moved:4 “That it be referred to the Works Committee to report on the advisability of re-metalling or tarmetalling the carriageway in the Stanley Street.” Seconded by Alderman Elstub and carried. Alderman Edwards moved:5 “That Holmwood Lane be tarmetalled throughout at an estimated cost of £143 and referred to the Works Committee.”Seconded by Alderman Cox and carried. Alderman Lewis moved:6 “That immediate steps be taken to have King Street between Forbes Street and St Peters Railway Bridge and Enmore Road from the Newtown Railway Bridge to Tram Terminus thoroughly watered during the summer months at the cost reported by the Works Committee at last meeting viz £4 weekly.”Seconded by Alderman Salmon. After considerable discussion the motion was withdrawn and the matter left in the hands of the Mayor. Alderman Lewis moved:7 “That the Works Committee be requested to report on the advisability and cost of remetalling Georgina Street.”Seconded by Alderman King and carried.
This concluded the business and the Council rose.

From the Under Secretary Department of Public Works (Circular 148)advising that Business Excellency the Governor in pursuance of Section 66 of the Local Government Act 1906 has appointed Mr W. G. B Smith PM to be a Revision Court to revise the Lists of Electors for the Municipality. Received.
From the same (Circular number 147) forwarding Draft Ordinances re Hardings Signs and Advertisements asking this Council to consider same at their early convenience and advise the Department if the same will suit the requirements of the District.Received and referred to the By laws Committee.
From the same (Circular number 145) advising that a Proclamation was published in Government Gazette number 152 of 4th December declaring the provisions of parts xviii xix xx xxi xxii xxiii and of paragraph (d) of Section 170 of the Local Government Act 1906 so far as they relate to Municipalities shall come into operation on 1st day January 1908. Received.
From the same (Circular number 143) re-rating of Occupied Crown Lands advising that the Colonial Treasurer has now given authority for local officers to accept service of Rating Notices and to lodge appeals where the necessary. Received.
From William Burton Smith stating that he has been appointed the Revision Cold to revise the lists of Electors for the Municipality of Newtown and that the court will sit on Monday 6th January Proximo at the Court House Newtown at 10 o’clock in the forenoon. Received.
From the Department of Public Construction stating that the Minister has approved of the Department contributing one half the cost of renewing the pathway fronting the Public school Premises at Enmore viz £9.17.6.Received and the work to be completed.
From Alf Brown with reference to certain alterations and repairs to his premises ordered by the Inspector asking if the Council will grant him an extension of time six weeks or two months as he has a chance of disposing of the property or building purposes.Received and request granted.
From Mrs Alice Gardiner acknowledging having received a written notice to repair the hall ceiling also guttering around the front of the Cottage and asking that the matter be allowed to stand over for a month. Received and request granted.
The Works Committeesubmitted their report dated 12th December 1907 dealing with various matters consisting of seven items remitted to them from the Council with their recommendations.The Mayor moved: “That the Works Committees report as now read be and the same is hereby adopted.”Seconded by Alderman Edwards and carried.
Motions Pursuant to Notice
The Mayor moved:1 “That the appointment of James Trahair on 3rd September 1907 in accordance with the suggestion of the Honorable the Minister for Public Works contained in circular number 18 as Valuer to collect the necessary information and to make the triennial valuation for the period commencing 1st January 1908 and ending 31st December 1910 be and is hereby confirmed and that the corporate seal be attached to the said appointment.”Seconded by Alderman Edwards and carried.2 “That in accordance with the provisions of the Local Government Act 1906 and the Ordinances and regulations made thereunder this Council do now proceed to appoint a Returning Officer to carry out General Election of Aldermen to be held on 1st February 1908.”Seconded by Alderman Edwards and carried.The Mayor in accordance with the foregoing then moved: Mr Archibald Macintosh Council Clerk be and is hereby appointed Returning Officer. 3 “That the two sums of five hundred pounds each placed on fixed deposit with the Bank of Australasia Newtown on 30th August last as a reserve be now withdrawn and placed to credit of the current account.”Seconded by Alderman Edwards and carried. 4 “That in accordance with the provisions of clause 39 of the Ordinances the Council appoint a Polling Place for the convenience of ratepayers in a central position in the City of Sydney.”Seconded by Alderman Edwards and carried.
This being the business the Council rose.
